Incoming President Rodrigo Duterte said during a press conference on Sunday, May 15, at Hotel Elena in Davao City that he will implement a 10 p.m. curfew for unaccompanied minors nationwide.
He would order police to arrest the parents of unescorted minor children who will be caught roaming the streets beyond the curfew hours.
“My order is this: not to arrest the child. The child must be taken into custody by the police and the agencies concerned. Then, go to the house to arrest the mother and the father for the crime of child abandonment,” the presumptive president told reporters.
As mentioned by GMA News Online, Duterte cited the Revised Penal Code of the Philippines as his basis for the order to arrest indifferent parents.
Article 277 of the Revised Penal Code titled “Abandonment of minor by person entrusted with his custody; indifference of parents” stated that the penalty of arresto mayor and a fine not exceeding 500 pesos shall be imposed upon anyone who, having charge of the rearing or education of a minor, shall deliver said minor to a public institution or other persons, without consent of the proper authorities.
It further stated that the same penalty shall be imposed upon the parents who shall neglect their children by not giving them the education which their station in life require and financial conditions permit.
