It looks like a viral news articles about a memorandum circular which has recently been exposed to be a fake can actually lead to plunder charges.
A fake memorandum from the Office of the Governor of the Bangko Sentral ng Pilipinas is recently making the rounds online. The memorandum, Circulation 49, contains a so-called agreement between the Philippines and Thailand's Centennial Energy Corporation, which permits the transfer of 3,500 metric tons of gold or 141-billion worth of gold bars with 99.999 purity to Thailand for humanitarian purposes. This was said to be in compliance with a prior agreement between the United States of America and Thailand.
The signatories were top Cabinet members such as former Department of Justice Secretary Leila De Lima,former Department of Finance Secretary Cesar Purisima, former Senate President Franklin Drilon, former Governor of the Bangko Sentral ng Pilipinas Amando Tetangco, and former President Benigno Aquino Jr.
The suspicious circulation which was first seen in social media circles prompted Rogelio Cantoria and lawyer Fernando Perito, to file corruption, plunder and graft charges against the said officials.
Netizens are enraged with the "shady transaction" and some have even pushed these offficials to face the death penalty.
However, it has been proven that the news article is indeed fake. According to an Inquirer article, the said BSP circular which cited a number of Republic Acts referred to wrong RA. For example, republic Act No. 7655 which has been said to state that “Centennial Energy (Thailand) Company Limited has given the authority to produce and issue the United States Dollars currency” is actually an “act increasing the minimum wage of househelpers.”
The fake photos has been published by the Facebook account of a certain Roland Polosan. The photos were in fact published in July last year and has become viral in social media before it was picked up by Cantoria and Perito.
